Maybe Nylanderia? All the Nylanderia I have found look like this but were closer to 5mm.

Yes, It is a queen.
 
1. Location of collection: Saved from drowning in a pool.
2. Date of collection: 8/11/2014
3. Habitat of collection: Sub-Urban
4. Length (from head to gaster): 3mm
5. Color, hue, pattern and texture: Brownish/greyish head, orange thorax, black gaster.
