I'm new to this and I want to know if this is a queen ant

 

1. Sidewalk in city

2.May 27 8:00 pm

3. Habitat Unknown

4. Approx. 4.3 mm

5. Color Black

What city in California?
Can you take a more clear picture? This one is probably too blurry for anybody to be able to identify species. It's actually difficult to tell that it's an ant at all  :D
