Possible Formica Rufa?

If it is I will have to let it go, but it's raining now so if it is should I wait until ot stops raining?

Found in my garden Belgium at an edge of a forest on the 23/05/2021 at 2pm, weather was ok, about 15°Celsius, not too humid id say about 70%, it had rained earlier in the morning. She was just walking in front of me, no known nests around the area and I have fully mapped my garden for ant nests, size can be seen in pictures. Last photo is next to Lasius Flavus.

Please urgent help I want to let her go if it is as it's a protected species and parasitic.

I think it is Formica rufa and you should wait until it stops raining before you release her.

Definetly rufa-group, those are the only Formica flying right now, release her as soon as possible,
