You will have to check your state's laws regarding this, but it is federally legal.
It does appear to be legal in the state of South Carolina. South Carolina doesn't have very harsh laws on keeping or transporting live organisms.

Keep in mind that interstate trade of the ants may also fall under the Lacey act.
From what I can find, the Lacey Act prohibits the interstate transportation of illegally captured or prohibited animals (it's mostly talking about birds and mammals in the Lacey Act). I don't think ants would fall under this.

Lacey Act covers everything!!! Wildlife. Insects included. If you obtain something illegally in one place you can't transport it to another even if it's legal there.

The question is, would ants be considered "illegally" collected in Florida? I'll have to check and see.

Okay, from what I have found out, it is only illegal to IMPORT insects into Florida, not export, so I'm good for the Cephalotes varians, as I'm exporting them from Florida, not bringing them in. I can fully understand why Florida doesn't want any insects being brought into the state, with all of the invasive species and crap.

Now I want one again. But unfortunately it breaks forum rules....
Yup. Oh well, maybe one day you'll get some. It requires a lot of climbing and very careful searching of dead twigs of specific plants. I suggest searching Red Mangrove swamps, as they're the most prevalent ant species in the swamps. I'm actually gonna model their nest off of a Red Mangrove swamp. It's gonna be a paludarium design.
